This is a very good question. Arbitration is a very useful tool in the State of Rhode Island, to increase the settlement award offered by the at-fault insurance company. Rhode Island has a statute, that permits plaintiff's counsel, to force mandatory arbitration, if the value of the case is $50,000 or less. Arbitration is still an option for cases with a greater value of $50,000. The benefit of arbitration, is that it is a much faster mechanism to effectuate the mediation and/or settlement of a claim, then dealing with the courts and filing a civil complaint. Filing a civil complaint is something that we often do, but arbitration and mediation is a great tool.
