Being involved in an auto accident on the job is a stressful process for many drivers. Being injured in this type of accident often makes things more difficult. It is hard to know what insurance claims to file, especially if you were driving your own personal vehicle. However, there are important things everyone should know regarding workers comp for an auto accident.
If you are in the course and scope of business at the time of the auto accident you qualify for workers comp. Your employer may try to deter you from making a claim under the workers comp policy and may push you to use either your own auto insurance or your own health insurance. Workers comp for an auto accident is a no fault, first party coverage. This means even if you were at fault for the accident workers comp will cover your medical bills.
In actuality, you will be unable to make a claim under your auto policy if you were in your own vehicle and were working at the time of an accident, unless you have a special endorsement. Even if you have this endorsement, the workers comp coverage is still primary for injuries sustained in an auto accident.
Your health carrier may pay bills initially, but will contact you for workers comp information once they review records and determine this was a work related injury. Many providers will not take any other form of coverage once they are aware you were working at the time of the accident due to workers comp restrictions and will actually ask for your workers comp information.
