Should Century 21 cover our car accident claim in this case?
My wife and I secured a car insurance policy from Century 21, which covered the period of May 10, 2008 to April 20, 2010. The policy offered coverage for two months after we became the owners of a new vehicle. On March 13, we bought a Chevy Blazer from a dealer, who handed us the certificate of title. We were then involved in an auto accident. Do we have a claim against Century 21 under Kentucky laws?

Title passed to you and your wife when the dealer delivered the certificate of title to you. You are the owners of the Chevy Blazer for purposes of insurance coverage under Kentucky's Motor Vehicle Reparations Act and the Century 21 policy. The Kentucky statute defines owner as "a person who holds the legal title of a vehicle or a person who pursuant to a bona fide sale has received physical possession of the vehicle subject to any applicable security interest." According to the Kentucky Supreme Court, title transfers to the buyer when the seller signs the odometer statement, completes and signs the assignment of title portion of the certificate of title, and hands over the completed title to the buyer. Transfer of title between a purchaser and a seller is not conditioned upon the prior filing of the paperwork.
