Question:

I was in a car accident because I ran a red light. Should my insurance company pay for my hospital bills? I had to go to the hospital and was treated for several broke bones, to the tune of several thousand dollars. What should I do?

Answer:

The answer to this question depends on the type of coverage you have and the location where you live. Your bodily injury liability coverage only covers damages you cause to someone else.  This means that in order for your medical bills that result from an accident you were responsible for to be paid, you must have personal injury protection or medical injury protection.

In some states, called “no fault” states, you are required to have purchased this coverage and your insurance carrier will pay your hospital bills. In other states, such coverage is an option policy addition and you will have to check with your carrier to determine whether you purchased the coverage or not. If you have personal injury protection (PIP) or its equivalent, your insurance company will pay your hospital bills. Otherwise, they likely will not. You should speak with an experienced car accident attorney to help you determine your best course of action and to help you explain the coverage options available to you.
