Question:

A car backed into mine while backing out of a parking space and caused damage to my vehicle.  I filed a claim with the driver's insurance company.  How do I know if the auto insurance adjuster is making me a fair offer?

Answer:

One way to ensure that the auto insurance adjuster is making a fair offer is to hire an independent adjuster and seek other repair estimates.  The adjuster must provide reasonable and just compensation for all losses and injuries resulting from the driver's negligence, and the injured party must be put in the same position he or she would have been in had the other driver not been negligent.  An adjuster's offer should be consistent with:

  1. Your injuries and the treatment you received
  2. The liability in question (whether the accident was entirely the other driver's fault)
  3. Impact of the accident on your life and enjoyment of life, a factor which could increase the value of your claim
  4. Medical expenses
  5. Lost earnings, and
  6. Transportation expenses

Adjusters usually multiply your necessary and reasonable medical expenses by two or three.
