I was struck by a Delivery Driver van in a
rear end accident. We had exchanged insurance information but I later realized
he only gave me the insurance coverage for the car, and not himself. I
contacted his insurance, and they were not willing to file the claim. What can
I do?

Depending on the state you live in, you may also be required by your insurance to have liability coverage up to a certain damage amount. However, both the driver of the van and the company which owns the van are liable for the claim. Before contacting the liable company's insurance provider to file your claim, you should have contacted a Car Accident Attorney to assume communication. What can happen is if you contact them on your own and give them a statement of what happend, if it is not worded tactfully, your statement can implicate the matter. A car accident attorney can expertly evaluate the liability issues, insurance polices/coverage, and litigate the matter to ensure a fair settlement amount.
