I was hit by a Delivery Truck Van and got into an accident, how do I recover damages and whos liable?

I was struck by a Delivery Driver van in a rear end accident. We had exchanged insurance information but I later realized he only gave me the insurance coverage for the car, and not himself. I contacted his insurance, and they were not willing to file the claim. What can I do?

Depending on the state you live in, you may also be required by your insurance to have liability coverage up to a certain damage amount. However, both the driver of the van and the company which owns the van are liable for the claim.
