Am I legally able to sue my step brother for car accident passenger injuries as he was at fault for the accident?
I was driving with my stepbrother, and we got into a car accident. It was obviously my stepbrother’s fault. He ran a red light. I am badly injured as a result- I broke an arm, fractured my back and got several cracked ribs from the airbag. Can I sue my stepbrother?

The answer to your question depends on your state, and whether they have something called the “intrafamily immunity” doctrine. This rule prohibits one family member from suing another for personal injury sustained in a car accident. It is designed to prevent insurance fraud. You should consult with a personal injury attorney who specializes in car accident and insurance law, who can help you to determine whether your state operates under this intrafamily immunity doctrine. Your attorney can also provide you with additional guidance on whether your stepbrother is considered to be a family member who would be covered under the intrafamily immunity doctrine.
