Can I take any legal recourse for being rear ended and incurring injuries that are preventing me from working?

I was rear ended in a car accident and received injuries to my spine.  The doctor said my recovery period may be close to one year.  I am an accountant at a large corporation and will have to miss a considerable time off of work.  I have a mortgage, student loans, and other financial obligations.  Do I have any legal recourse for my auto accident injury claims?

If the party who rear ended you was at fault for your back injury from car accident, you may be able to seek legal recourse in civil court. If you are successful in your civil action, you will be entitled to receive damages for your injuries. Specifically, compensatory damages will help you with your financial situation. Compensatory damages are designed to place a victim in the position he or she would be in if the injury had never occurred. The court assigns a dollar amount on the victim's injuries which is intended to restore the victim financially, physically and emotionally. Compensatory damages for monetary losses include medical expenses, the costs of living with a potential disability, lost wages, and repair or replacement of property. In regards to lost wages for your current job, a victim typically may recover any wages lost while recovering from an injury and any lost earning capacity suffered as a result of an injury. If you have not already done so, you may also try to receive compensation from the offending party's insurance company.
