I let my friend borrow my car and he got into an accident, how does insurance assess who is held liable and at fault?

I let my buddy drive my car to test it out. Its a sports car (camaro) so he wanted to see how it was because he was thinking about buying one. So he accidentally rear ended someone while I was in the car with him and the damage is moderate. Who will be held at fault for this accident? Will this go on my record? Will my points go up and effect my car insurance rates?

In this type of situation, the accident itself may not go on your actual Driving Record. However, car insurance coverage usually follows the person under which the car is insured. So even though you were not driving, its your insurance thats going to have to pay for that damage. Thus, your points can go up. If you feel your insurance is being unfair in providing proper compensation as per the agreements, you can always consult with a Car Accident Attorney to review and help litigate the claim with your insurance company for you.

It all depends on the regulations and policies of the insurance company you are using, and the extent of the coverage you had. I suppose if you wanted to, it may be possible to sue your friend in a small claims court to recover for damages, but thats a decision you have to make entirely on your own.
