If you do not have insurance, the other drivers insurance provider will do everything in their power to refuse paying for your damages, and due to certain state laws, they would legally be able to do so. Before you had made your statement to the other parties insurance company, you should have consulted with an Attorney as that would have been extremely important and helpful.
You would be able to hire an attorney and take the other driver to a small claims court where you could usually recover up to $7,500 of the damages. Good luck to you.
